1 Use of websites
1.1 By viewing any of the Websites listed above ("the Website") the user ("you") is deemed to consent to all terms and conditions set out below. If you have any questions regarding the terms and conditions, you should contact the Company Secretary at UCAS.
1.2 UCAS reserves the right at all times to vary, change, alter, amend, add to or remove any of these terms and conditions. By browsing the Website you accept that you are bound by the current terms and conditions and notices. Please ensure that you review these terms and conditions each time you revisit the site as you will be deemed to have accepted a variation if you continue to use the Website after the variation has been posted.
1.3 The current draft of these terms and conditions was adopted and published on 1 June 2002 and amended on 22 February 2007.
2 Copyright
2.1 All copyright and other intellectual property rights in any material contained on the Website are either owned by UCAS or have been licensed to UCAS by the rights owners. The Website contains trademarks which belong to UCAS or which have been licensed to UCAS by the trademark owners, for use on the Website. Your use of these trademarks is forbidden unless prior written permission has been obtained from the trademark owner.
2.2 You may access any part of the Website and download or copy material (by printing off individual pages onto paper) or download material on to disk (but not on to any server or other device connected to a network) for personal non-commercial use only. The intellectual property rights in such material shall be retained by UCAS or, where the material has been licensed to UCAS, by the owners of the rights in the material.
2.3 Links to the Website (comprising http://www.ucas.ac.uk/, http://www.ucas.co.uk/, http://www.ucas.com/), are not permitted other than to the respective Home Page for personal use except with prior written permission. Links to the Website from within a frameset definition are not permitted except with prior written permission.
2.4 You may not remove any copyright, trademark or intellectual property notices contained in the original material from any material downloaded or copied from the Website.
2.5 Copying, distributing or any use of the material contained on the Website for any commercial purpose is prohibited.
2.6 You may not create a database by systematically downloading substantial parts of the Website.
3 Disclaimer
3.1 The content of the Website is for general information only and does not constitute any form of advice or recommendation upon which a specific decision should be made. 3.2 To the fullest extent permitted by law UCAS will not be liable for any claims, costs, penalties, loss (whether direct, indirect or consequential and whether economic or special loss), damages or expenses arising from the use or from the inability to use the Website or from reliance on information or on advice contained on the Website or from any unauthorised access or alteration to the Website by a third party.
3.3 Nothing in these terms and conditions shall exclude liability for death or personal injury directly caused by the negligence of UCAS nor any other liability which cannot be excluded or limited under applicable law.
3.4 UCAS will try to make the Website available but cannot guarantee that the Website will operate continuously or without interruptions or be error free and can accept no liability for its unavailability. You must not attempt to interfere with the proper working of the Website and in particular you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other internet connected device. You are also advised to use the appropriate antivirus software before and during access to the Website.
3.5 The entry profile is given as a guide as to the likely qualification requirements for entry to a course. There are only limited places on each course and possession by an applicant of the criteria for selection indicated by the appropriate entry profile will not automatically ensure admission to that course. Each institution assesses applicants on an individual basis and then makes its offers accordingly.
3.6 The Stamford Test is provided to give guidance to persons seeking information concerning courses, at Universities and Colleges, which may be of interest to them.
3.7 The Website includes links to external websites. These links are provided to help you find additional information quickly and easily. UCAS accepts no responsibility for the content of these websites and specifically excludes (to the fullest extent permitted by law) all liability that may arise with respect to or as a result of such material causing damage, costs, injury or financial loss of any kind.
3.8 Whilst the Website may from time to time contain advertising material, UCAS does not endorse or accept any liability for any of the products or services so advertised, or for any error or inaccuracy in the advertisements. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Website complies with all relevant laws.
4 Personal Information
4.1 "Personal Information" is information about you, which you provide to UCAS from the input areas within the Website (comprising: http://www.ucas.ac.uk/; http://www.ucas.co.uk/; http://www.ucas.com/). This is subject to a privacy policy as set out below. The information we collect may include: name; postal and email address; telephone number, both home and mobile.
4.2 Where your Personal Information is provided in connection with an application to an educational institution, your Personal Information will be shared with educational institutions in accordance with the information provided in the applications section of the Website.
4.3 Your Personal Information may also be used by UCAS in order that you may be sent information, on behalf of other organisations, about products and services directly relevant to higher education applicants but only in accordance with the privacy policy in clause 5 below.
4.4 Where you provide us with your postal address, email address, mobile telephone number and home telephone number, it is essential that you inform us of any change to them.
5 Privacy Policy
5.1 At UCAS we have adopted the following privacy policy as part of our commitment to protect your Personal Information.
5.2 We will not sell, trade or rent your Personal Information to others. With your permission, we may send you information considered relevant to students, on behalf of carefully chosen, reputable and trustworthy third parties, for purposes outlined in 4.3 above. We will follow the appropriate legal requirements to ensure that no third parties see your Personal Information save as set out in these terms and conditions.
5.3 If you do not wish your Personal Information to be used for marketing purposes by post you must ensure that you tick the box on the relevant page.
5.4 You will need to tick the appropriate boxes if you wish to receive such information by electronic means.
5.5 The Website may contain links that make it easy for you to visit other websites. UCAS does not have any control over these websites. Therefore, if you use these links to leave UCAS and visit websites operated by third parties, UCAS cannot be responsible for the protection and privacy of any information that you provide whilst visiting these websites.
5.6 UCAS may use cookies. A cookie is a small amount of data which is stored on your computer and which is revealed to UCAS when you use this Website. UCAS uses cookies only to make it easier to identify you when using the Website. UCAS does not use cookies to collect additional information about you. You can configure your web browser not to accept cookies, although this may hinder the functionality of the Website for you.
5.7 You may, at any time, withdraw your permission for UCAS to use your Personal Information for the purposes of sending you information about products or services by writing to the Company Secretary, UCAS, Rosehill, New Barn Lane, Cheltenham, Glos GL52 3LZ. You may also write to our Company Secretary if you have any questions, or wish to have any of your Personal Information edited or deleted.
5.8 Under the Data Protection Act 1998 you may request UCAS to provide you with details of Personal Information that UCAS holds about you. If you want to make a request for this information you should write to our Company Secretary at the above address. There will be a fee of £10 payable. A cheque for this amount should be sent to UCAS with your request for information.
6 General
6.1 These terms are not intended to confer any benefit on a third party under the provision of the Contracts (Rights of Third Parties) Act 1999.
6.2 Any rights not expressly granted herein are reserved to UCAS.
6.3 UCAS reserves the right, at any time, to suspend or terminate your access to, or use of, the Website.
6.4 UCAS will always seek criminal prosecution of any individual who or organisation which seeks to use UCAS' name, material, logos or trademarks for unlawful purposes and, where appropriate, will take action within the civil courts of any applicable jurisdiction against any individual or organisation discovered to be using UCAS' name, logos, trademarks or the Website for unauthorised or unlawful purposes.
6.5 These terms & conditions of use shall be construed and interpreted in accordance with English law. The courts of England shall subject as set out in clause 6.6 have exclusive jurisdiction in relation to any claim, dispute or other matters arising therefrom.
6.6 For the exclusive benefit of UCAS, UCAS shall retain the right to bring proceedings in the Courts of the country of residence of any user of the Website.
6.7 If any provision of these terms and conditions is found to be invalid by any Court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions which shall continue to have full force and effect.
6.8 The failure by UCAS to exercise any right or remedy under these terms and conditions shall not constitute a waiver of that right or remedy.
